What is court action?

Court action is the issuing of legal proceedings against a person(s) or company.

If you are unable to reach a suitable agreement with the debtor in regards with what they owe you, or they have simply ignored your letter before action, then it is time to take legal action.

This is the necessary next stage of your debt recovery claim when recovering your debt has reached an impasse.

There are three types of Courts where your claim may be heard: the Small Claims Court, the County Court or the High Court.

Issuing proceedings for debt recovery

You can always issue proceedings on your own, but we would never advise this as any mistakes made are difficult to amend once submitted, which can prevent the success of your case.

Small Claims Court

The Small Claims Court deals with claims of up to £10,000 in value.

You may not think this is a small value, but if the amount of debt owed to you is £10,000 or below, then your claim will likely be handled at a Small Claims Court.

You can make your claim to the Small Claims Court here, although we would advise leaving this to us as we have the experience and technology to ensure this process will take place without problems.

At the Small Claims Court, the final hearing will be quick and informal. In most cases, there will be no solicitors or barristers present. Your preparation, evidence and documents will be what the Judge requires to decide the outcome.

County Court

County Courts tend to deal with money claims of up to £100,000 but can sometimes deal with small claims of less than £10,000.

For County Court cases you do not need to be represented by a barrister, but we would be in a better position to advise you on this once we have a better understanding on the complexity of your case and whether we believe they would maximise your chances of success.

If we do advise the use of a barrister for your debt recovery claim, you can rest assured that we will recommend you the most suitable from our comprehensive list of reliable and expert barristers that we have worked and won with over the years.

High Court

The majority of debt cases will be handled at a Small Claims Court or County Court.

To be able to apply through the High Court, your case would need to be of very high value or it is considered a complex case.

The value of your debt recovery claim would need to be in excess of £100,000 for it to be heard in the High Court, and we would advise you in detail if this is the case.

The High Court is split into 3 divisions: the Queen’s Bench Division, the Family Division and the Chancery Division.
