One of the most common concerns among clients is whether there will be any deductions from their compensation settlement.
Scott Rees Partner Jonathan Evans, who heads the firm's Employer Liability and Public Liability department, said many claimants worry they will have to pay legal costs out of their damages. Simiarly, they also worry about having to pay legal costs if their case is unsuccessful.
Jonathan explained: "We constantly have to reassure clients that there will be no deductions from the compensation that's been negotiated for them. We also spend a considerable amount of time explaining exactly how a claim is processed and funded.
"Many people fear that they are going to be presented with a legal bill at the end of the case. At a time when the client is coping with changes to their personal circumstances as a result of an accident, it's a real concern for them."
Under the current system, the costs of pursuing a case are paid by the insurance company of the party at fault. This includes charges such as the solicitors' success fee, an insurance policy known as After the Event insurance, as well as disbursements to cover items like the commissioning of medical reports.
Should the claim be unsuccessful then the After the Event insurance policy is in place to cover the costs incurred.
Under Government plans currently being debated however, the way claims are funded is likely to change with more responsibility upon the claimant to pay towards the cost of pursuing their case.
